We offer a range of marketing tools and resources to our clients, facilitating effective brand promotion and customer engagement. To avail our services, clients must register on the platform by completing the online registration form and agreeing to these Terms and Conditions.
Clients confirm to LevelCasinos.com that they are not individuals under the age of 18 and possess the legal rights to access the marketing services. If under 18, they must obtain consent and registration assistance from a parent or guardian.
This Agreement becomes active upon the client’s registration and will remain in effect until terminated.
Clients are solely responsible for ensuring their marketing activities through our platform align with relevant legal and regulatory standards.
LevelCasinos.com reserves the right to delegate these terms and conditions to any entity of its choosing.
ARTICLE 1: DEFINITIONS
PLATFORM: The LevelCasinos.com Software available online, which offers various marketing tools and resources to clients.
CLIENT: Any person or entity registered on the platform to use the marketing services provided by LevelCasinos.com.
MARKETING CAMPAIGN: Specific promotional activities or strategies devised and implemented using the platform’s resources.
ACTIVE CLIENT: A client who accessed their LevelCasinos.com account at least once during the past 24 months.
INACTIVE CLIENT: A client who hasn’t accessed their LevelCasinos.com account for the past 24 months.
CLOSED ACCOUNT: An account that the client can no longer access.
ARTICLE 2: PURPOSE
This Agreement aims to establish the conditions for using the platform’s marketing services and the associated fees payable to LevelCasinos.com.
ARTICLE 3: OBLIGATIONS OF LevelCasinos.com
LevelCasinos.com is dedicated to ensuring seamless operation of the platform, providing clients access to all offered services as per this Agreement. If there’s a technical issue that disrupts the platform’s functionality and it’s beyond our control, we commit to promptly notify the client and resolve the issue.
We also pledge to securely store and maintain clients’ digital information, ensuring they can consistently access campaign statistics.
LevelCasinos.com has the right to accept or reject any new client. In case of denial, we aren’t obliged to provide an explanation or compensation.
ARTICLE 4.1: OBLIGATION OF CLIENTS
Clients are responsible for effectively using the marketing resources provided by LevelCasinos.com. This includes, but isn’t limited to, integrating the tools in their marketing strategies and adhering to the best practices we recommend.
Clients must seek approval from LevelCasinos.com before launching significant campaigns to ensure they meet the platform’s standards and the requirements of any third-party associations.
Non-compliance with these standards could result in the suspension or termination of the client’s access to certain services. Any related pending fees might also be suspended.
By accepting our Terms and Conditions, clients also agree to our Privacy Policy and Cookies Policy.
ARTICLE 4.2: OBLIGATION OF CLIENTS – SPECIFIC CLAUSE
Clients are strictly prohibited from promoting or engaging in paid VIP groups on their website or social media channels through our platform. Violating this clause will result in account closure and any unpaid fees will be forfeited.
ARTICLE 5: FRAUD
Any activities or tactics aiming to unjustly increase the fees owed to the client are strictly forbidden. If a client is found engaging in fraud, this Agreement will be immediately terminated without notice or compensation. LevelCasinos.com reserves the right to recover any unduly paid amounts and may pursue legal action.
ARTICLE 6: BILLING AND PAYMENT
Charges for our services include, but aren’t limited to, Campaign Management, Consultation, Analytics Services, and more. Payments are processed bi-monthly, with a minimum payment threshold of 100 Euro. LevelCasinos.com isn’t responsible for any commission payment delays.
ARTICLE 7: CHANGES TO CLIENT WEBSITES
Any modifications to the name or hosting location of the client’s websites won’t affect this Agreement. However, clients must notify LevelCasinos.com of any major alterations to their website that might influence the effectiveness or relevance of the marketing campaigns facilitated by our platform.
ARTICLE 8: LIABILITY
Neither Party shall be held accountable for any indirect losses or damages suffered by the other party due to their use of the platform. The total liability of LevelCasinos.com shall not surpass the amount paid by the client during the six months preceding the event or circumstance leading to the claim.
ARTICLE 9: FORCE MAJEURE
No party will bear responsibility for any failure or delay in performing its obligations under this Agreement if such failure or delay is due to unforeseen events beyond their control. This includes, but isn’t limited to, natural disasters, political upheavals, wars, or strikes.
ARTICLE 10: INTELLECTUAL PROPERTY
Clients don’t possess any intellectual property rights over the marketing tools, products, or services provided by LevelCasinos.com. However, for the duration of their active campaign, LevelCasinos.com grants clients a non-exclusive license to use the marketing materials and tools available on the platform.
ARTICLE 11: TERM AND TERMINATION
This Agreement will be effective indefinitely from the date of the client’s registration. However, it can be terminated under various conditions, such as breach of terms, voluntary exit, or prolonged inactivity. In the event of termination, the client must discontinue using all LevelCasinos.com services and return any confidential information or materials in their possession.
ARTICLE 12: GENERAL PROVISIONS
This Agreement embodies the full understanding and agreement between both parties. Any alterations, waivers, or amendments to this Agreement must be documented in writing and endorsed by authorized representatives from both parties.
ARTICLE 13: GOVERNING LAW AND JURISDICTION
This Agreement is governed by the laws of Malta. All disputes arising from or related to this Agreement shall be resolved through arbitration in compliance with the Malta Arbitration Act and the Arbitration Rules of the Malta Arbitration Centre.
ARTICLE 14: RESPONSIBLE MARKETING AND GAMBLING AWARENESS
Commitment to Responsible Marketing: LevelCasinos.com is dedicated to upholding the highest standards of responsible marketing. We recognize the importance of ensuring that all marketing materials, campaigns, and strategies delivered through our platform do not encourage reckless or harmful behavior and are in full compliance with ethical standards and relevant laws.
